United States v. Morales-Alonso

by
The Eleventh Circuit affirmed the district court's imposition of a sentencing enhancement that applied when a defendant has been deported after committing a "crime of violence" as defined by USSG 2L1.2(b)(1)(A)(ii). The court held that defendant's previous conviction under Georgia law of aggravated assault as defined by O.C.G.A 16-5-21(a)(2) was a crime of violence under the operative version of USSG 2L1.2 and warranted the 16-level sentencing enhancement provided for in section 2L1.2(b)(1)(A)(ii).
