Tharpe v. Warden

The Eleventh Circuit held that its order denying a certificate of appealability (COA) to petitioner in this case should not be reconsidered. The court held that petitioner was not entitled to a COA for two distinct reasons: first, his claim arose from the rule announced in Pena-Rodriguez v. Colorado, 580 U.S. ___, 137 S.
